Dipak Misra Biography

Justice Dipak Mishra is the Chief Justice of India. He is the 45th Chief Justice of India, succeeding the 44th CJI, Justice J. S. Khehar. 


Born on October 3, 1953 Justice Dipak Misra was enrolled as an Advocate on 14th February, 1977 where he practiced in Constitutional, Civil, Criminal, Revenue, Service and Sales Tax representing his clients in the High Court of Orisaa and the Service Tribunal. He took over as an Additional Judge of the Orissa High Court on 17th January 1996. Misra was transferred to the Madhya Pradesh High Court on 03rd March, 1997 (Permanent judge on December 19 the same year). He took over as the Chief Justice of Patna High Court 23 December 2009 and later Chief Justice of Delhi High Court on May 24 2010. Justice Misra was appointed as a judge of the Supreme Court on 10 October 2011. Justice Mishra has been appointed the 45th Chief Justice of India from 28 August 2017 till 2 October 2018, the day he retires on turning 65 years in age. Justice Mishra will be serving as the CJI for a term of 13 months and will retire on October 02,2018. He's the nephew of Justice Ranganath Mishra, who was the 21st CJI during 1990-91.

As a Judge Dipak Misra is known for his verdict in the case of Yakub Memon and his judgement considered as one of landmark judgements as a the Supreme Court judge. Misra was one of the members that led the bench which rejected 1993 Mumbai serial blasts convict's appeal to stop his execution. Justice Dipak Misra received a written death threat but he refused to bow down. The terror groups had openly threatened him by writing a letter that read "irrespective of the protection you may avail, we will eliminate you".  Misra's other verdict in the case of Own Motion vs State that Delhi Police upload FIRs on their website within 24 hours of their lodging to enable the accused to file appropriate applications before the court for redressal of their grievances was a notable one.

 

Justice Dipak Misra, who led the Supreme Court bench that confirmed death to four convicts in the Nirbhaya gang-rape case, is set to be the next Chief Justice of India in August

 

In another case dealing with the Reservation in promotions in UP, he alongwith Justice Dalveer Bhandari supported the Allahabad High Court judgement that reservation in promotions can only be provided if there is sufficient data and evidence to justify the need. Thus the bench consisting Justice Dalveer Bhandari and Misra rejected decision of U.P. government regarding reservation saying it failed to provide enough valid data. Misra helped in deciding more than 5000 cases that was big boost in clearing the cases. He was instrumental in setting Mediation Centre in court area and made Lok Adalats more effective.
